Terms of use

1- General Points
1.1 HubPaper’s General Sales Agreement are made to define the relations between HubPaper SAS, with a capital of 38 000 euros registered at the RCS of Lille under number 514485432 and with its Headoffice located 54 rue des Eaux in Lille, represented by Antoine Monchecourt - CEO, editor of www.hubpaper.com and the users of the services offered on hubpaper.com or on our partner’s sites.
- «HubPaper.com» represents the site and HubPaper’s services
- «The user» represents the simple visitor, the customer, or the Member registered on HubPaper.com
- «The Partner» represents a site which accepted to exchange a link with HubPaper.com

1.2 The user declares to have read, understood and accepted the hereby General Sales Agreement. He also declares that he is legally capable to give his approval to them, and fully agree without restriction. If the user is under 18, or disabled, he declares to have the authorisation of a parent, tutor or trustee.

1.3 All the rules, broadcasted on the Site are part of the hereby General Sales Agreement, which the User is committed to respect.

1.4 HubPaper.com services can be offered on Partner’s Sites adapted to the Partner’s graphic plan ( in White Mark). The relations between the users and hubpaper.com remain the same that the one on hubpaper.com. The Partner’s site eventual specific conditions are defined and are added to the one already defined here.

1.5 HubPaper.com has the right to modify the General Sales Agreement without notice, as well as all the associated elements. The new clauses will be applicable even retrospectively for all the relations between hubpaper.com and the users.

1.6 The fact that HubPaper tolerates from a user or a third party a lack of their obligations planned in the General Sales Agreement, or does not apply a right from the same General Sales Agreement, cannot in any case be interpreted as a release from its side, to apply the User’s obligations. This disposal is valuable regardless of the tolerance’s duration or the number of users concerned.

1.7 HubPaper SAS Company has the right to outsource or leave to a third party the obligations previously mentioned.

2- Responsibility
2.1 HubPaper.com has only an obligation concerning the continuity of its services.
HubPaper does not have to provide results, especially and in particular without limitation, and cannot be blamed for:
- Any damages from a third party
- In case of a breakdown, technical issue, in particular due to the programs, materials, or informatics software or Internet network. This lack of responsibility does not restrict to discontinuation, suspension or services closure.

2.2 HubPaper.com cannot be held responsible for direct or indirect damages caused by a data loss, dishonest behaviour, Hacking, or by the accidental broadcast of a virus or any other damaging element, due to the user’s or third party’s behaviour.

2.3 HubPaper.com cannot be held responsible for the documents published by the User.
The user is the only responsible of the documents he published trough HubPaper.com
HubPaper.com allows the users to publish online documents by changing their final aspect, without control, and by respecting the User’s instructions.
HubPaper.com cannot be assimilated as an editor and therefore does not handle the same rules.

2.4 The user cannot take HubPaper.com, HUBPAPER SAS company, its employees and Managers responsible for any damages resulting from the Site’s use or its associated services, and this apply for any reason or real damage.

2.5 If HubPaper’s responsibility would have to be involved for any case, whatever the form of action or cause is, it could not exceed all damages confused, the amount paid by the user to hubpaper.com in a first place.


3- Access to the services conditions
3.1 HubPaper.com can put general rules and limits down in regards with the services use, and without limitation, apply:
- A maximum period of days, within the which the e mails, messages displayed in the forum, or any other downloaded content will be kept; a maximum number and size for the e mails that can be sent and received by an account.
- A maximum memory space, allocated on HubPaper.com’s networks.
- A maximum number of access to a service during a given period ( as well as the maximum time of each access). Hubpaper.com does not bring any guarantee for the loss or storage default of any message, communication or any broadcasted or forwarded content.

3.2 At the end of the subscription’s process, the User receives an account’s name and password, and other informations depending on the services used. The User is the only responsible of the confidentiality of his account and password and of any actions made from the account. The User has to inform HubPaper.com straight away, for any fraudulent use of his account. HubPaper cannot be held responsible for any loss, damages, or security intrusion, without any previous notification. The user commits to update the database in order to keep the data accurate, and this on a regular basis.

3.3 HubPaper has the right to modify or completely stop the service, temporarily or for good, and this without being held responsible by the User.
HubPaper.com also has the right to stop the access corresponding to the User’s account and password, or to delete them, as well as to remove and move any content on HubPaper.com, for any reason, and especially for a long non use period of time. Any access cancellation to the service in application with the terms, can take place without legal notification.

3.4 The user accepts that the service and any software used in relation with the service can contain informations protected by the intellectual law property. Hubpaper.com allows the user to use the software. It is forbidden to copy, modify, create a branch off, reverse the  conception or the assembling, to try to find out the source code (except the cases  planned by law), sell, licence, or transfer in any way, any rights pertaining to the software. The user is committed not to modify the software in any way, not to use modified versions and especially (without limitations) in order to obtain a non-authorised access to the services. The user is committed not to access the hubpaper.com services by another way than the interface provided by hubpaper.com


3.5 The user accepts to use the services at his own risks. Hubpaper.com does not guarantee that:
- The services will completely meet your expectations
- The services will not be disrupted, sure, or without errors.
- The results obtained by the services will be accurate. Any download is made at the risk of the user, who will therefore be the only responsible for a potential damage caused to his informatics equipment or any data loss.

3.6 The user is committed to exclude from his messages any fake, obscene, aggressive, abusive, racist, malicious or illegal content.
In case of non respect by the user of the previous rules, the website ethics, or the Internet rules, HubPaper has the right to suspend or cancel the user account and therefore, to forbid access to the website, delete the user’s data and files.

4- Personal Data
4.1 According to the law, the user, can access to his informations anytime, and can ask for modifications or removal. At the closure of the account, the data can be archived and keep confidentially for a maximum period of the time of common rights and civil actions.

4..2 HubPaper.com does not transmit user’s personal data except in the case of necessary function of the service and with the user’s agreement. However, and without transmitting the user’s details, hubpaper.com can send commercial offers from third party. Every user can refuse by modifying the preferences in his member’s space.

4.3 The user allows hubPaper.com to confidentially keep and archive the informations even after the closure of his account and for a period of time than cannot excess the time of common right and civil actions (2262 article, civil right)

4.4 As a departure from the article 4.2, HubPaper.com has the possibility to communicate to a third party, all necessary informations and reasonably useful, in regards to the law, for any legal, administrative requests, from the police. HubPaper.com also has the possibility to do such things, in order to protect itself, and the users, from a third party.

4.5 The user is informed that, for a good use, hubpaper.com is using cookies, which may contain personal informations.

5- Costs, operations of the account and payment
5.1 The fees and sales agreement in effect are fully part of the hereby conditions.
HubPaper.com is committed to highlight them and to remind them before each service’s purchase offered by Hubpaper.com

5.2 Every user has a virtual currency account and a «transactions» account. These accounts can be toped up by cheque or credit card payments, via surtaxed phone calls, or promotional offers, sponsoring or partners offers, without limits.

5.3 Payments by credit card (Blue Card, VISA, Euro-Card-Mastercard, AMEX) are made via a secure process and directly on the HSBC Bank website. The payment’s security is processed via authentication, based on the confidentiality and data wholeness. To ensure this security, cryptography techniques are used. You card will be debited as soon as the order is taken.

5.4 Every amount paid will be consider as final and will not be reimbursed.

5.5 In case of an account’s closure or for any other serious reasons, decided by HubPaper.com, the reimbursement will be made for a maximum amount of the one paid to HubPaper.com, in the case the payment of this one has previously been processed with success.
In no case, the free credits received will be reimbursed. The credits received from the surtaxed calls will be compensated in the limit of the part given by a third party collectors, in favour of HubPaper.com

5.6 Any contest, regarding the account’s functioning, the debit or credit operations appearing, will have to be mentioned to HubPaper.com in a 30 days maximum period of time, from the date the operation has been contested. After this date, the statement of the account will be assumed as accepted by the user and no claims will be accepted afterwards.

6- Various disposals
6.1 HubPaper.com has the possibility to make commercials appear on his site, or to use in general hyper-links referring to external links. In no case, HubPaper.com will be held responsible for these site’s contents, products or services, neither for any damages that could intervene following the visit or the use of these sites.
 
6.2 Every person including a hyperlink on HubPaper.com will take the responsibility towards HubPaper.com and the third party.

6.3 All the elements figuring on the site, inserting by Hubpaper or by his advertisers, are protected by the rights on the intellectual property and belong to their respective owners.

6.4 Any partial or total reproduction of the website or its content is strictly prohibited. The informations and database cannot be used, printed, or copied for another use than a private and familial use.

7- Online Publications and Copyright
7.1 The user declares being holder of his rights (especially copyright, and image right) from the documents he sends on HubPaper’s network.

7.2 Failing to do so, he declares that these documents are free of business concern and / or that the necessary authorisations (copyright transfer, use of image right, licence of intellectual property...) have been obtained, allowing in particular their copy, their representation, their adaptation, their distribution.

8- Applicable texts and competent jurisdiction
8.1 The hereby General Sales Agreement, as well as more generally every relations between hubpaper.com and the users are exclusively governed by the French Laws
regardless of the place of residence of the user, and even in a case of Law conflicts.

8.2 If one of the disposal would have to be considered as illegal by a competent authority, this disposal would simply be repute non written, all the other disposals keeping their obligations between the parts.

8.3 Any dispute will be exclusively treated by a court in Lille. The only fact to use the website works as an agreement for the user to respect the above clauses mentioned in the General Sales Agreement.
